AGREEMENT TO TERMS
These Terms and Conditions constitute a legally binding agreement between you and myHHBS ("Company," "we," "us," or "our") concerning your access to and use of our website and services. By accessing our website or engaging our services, you agree to be bound by these Terms and Conditions.
1. SERVICES DESCRIPTION
myHHBS provides Applied Behavior Analysis (ABA) therapy and autism support services including:
- In-home ABA therapy
- Center-based ABA therapy
- Daily living skills training
- Behavioral assessments and treatment planning
- Parent training and support
- Educational consultations
Our services are designed for children with autism spectrum disorder and other developmental disabilities.
2. CLIENT ELIGIBILITY AND ENROLLMENT
2.1 Age Requirements: Our services are designed for children and adolescents with developmental disabilities.
2.2 Intake Process: All clients must complete our intake process, including:
- Initial consultation and assessment
- Review of medical and educational records
- Insurance verification (if applicable)
- Completion of all required forms and consent documents
2.3 Medical Requirements: Clients must have appropriate diagnoses and physician referrals as required by insurance or regulatory requirements.
3. INSURANCE AND PAYMENT TERMS
3.1 Insurance Coverage: We work with various insurance providers. Coverage is subject to verification and approval by your insurance company.
3.2 Payment Responsibility: You are responsible for:
- Any deductibles, copayments, or coinsurance required by your insurance plan
- Services not covered by your insurance
- Payment for services if insurance denies coverage
3.3 Payment Methods: We accept payment by cash, check, credit card, and electronic payment.
3.4 Billing: Invoices will be provided monthly. Payment is due within 30 days of the invoice date unless other arrangements have been made.
4. APPOINTMENT SCHEDULING AND CANCELLATION
4.1 Scheduling: Appointments are scheduled based on therapist availability and your family's needs.
4.2 Cancellation Policy:
- Cancellations must be made at least 24 hours in advance
- Late cancellations (less than 24 hours) may be charged
- No-shows may result in a full session charge
- Excessive cancellations may result in service termination
4.3 Rescheduling: We will make reasonable efforts to reschedule cancelled appointments based on availability.
4.4 Provider Cancellations: If we need to cancel or reschedule, we will provide as much notice as possible.
5. CLIENT RESPONSIBILITIES
You agree to:
- Provide accurate and complete information during intake and ongoing services
- Attend scheduled appointments or provide appropriate notice of cancellation
- Maintain a safe environment for in-home services
- Follow treatment recommendations and implement behavior plans
- Communicate openly with our staff about concerns or changes in your child's condition
- Review and sign all required consent forms and documents
- Pay for services in accordance with our payment terms
- Notify us of changes to insurance coverage or contact information
6. CONFIDENTIALITY AND HIPAA
6.1 Protected Health Information: We comply with the Health Insurance Portability and Accountability Act (HIPAA) and maintain strict confidentiality of all client information.
6.2 Permitted Disclosures: We may share information:
- As authorized by you in writing
- As required by law or court order
- To coordinate care with other healthcare providers (with your authorization)
- For billing and insurance purposes
- To protect against threats to health or safety
6.3 Privacy Practices: You will receive our Notice of Privacy Practices that provides detailed information about our privacy policies.
7. TREATMENT AND CLINICAL DECISIONS
7.1 Professional Judgment: All treatment decisions are made based on professional clinical judgment and best practices in ABA therapy.
7.2 Treatment Plans: Individual treatment plans are developed based on assessment results and ongoing data collection.
7.3 No Guarantees: While we strive for positive outcomes, we cannot guarantee specific results from our services.
7.4 Right to Refuse Treatment: You have the right to refuse or discontinue services at any time.
8. SERVICE TERMINATION
8.1 Voluntary Termination: Either party may terminate services with written notice. We recommend at least 14 days notice to ensure proper transition.
8.2 Involuntary Termination: We reserve the right to terminate services if:
- Payment obligations are not met
- Client or family behavior threatens staff safety
- Treatment recommendations are consistently not followed
- Excessive appointment cancellations occur
- Services are no longer clinically appropriate
8.3 Discharge Planning: Upon termination, we will provide appropriate discharge planning and referrals if needed.
9. PROFESSIONAL CONDUCT AND BOUNDARIES
9.1 Professional Relationships: Our staff maintains professional boundaries with all clients and families.
9.2 Gifts and Gratuities: Staff cannot accept gifts of significant value from clients or families.
9.3 Outside Relationships: Staff should not engage in social or business relationships with clients outside of professional services.
10. SAFETY AND EMERGENCY PROCEDURES
10.1 Emergency Situations: In medical emergencies, call 911 immediately. We are not an emergency service provider.
10.2 Crisis Management: Our staff are trained in crisis intervention and behavior management techniques.
10.3 Incident Reporting: Any incidents or injuries will be documented and reported according to regulatory requirements.
11. RECORD RETENTION
11.1 Clinical Records: We maintain clinical records in accordance with state and federal regulations.
11.2 Record Requests: You may request copies of your child's records in writing. Records will be provided in accordance with HIPAA requirements.
11.3 Record Fees: Reasonable fees may be charged for copying and mailing records.
12. INTELLECTUAL PROPERTY
12.1 Website Content: All content on our website, including text, graphics, logos, and images, is our property and protected by copyright laws.
12.2 Treatment Materials: Treatment materials and behavior plans developed for your child are for your personal use only and should not be shared publicly without our permission.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid for services
- We are not responsible for outcomes beyond our reasonable control
14. DISPUTE RESOLUTION
14.1 Informal Resolution: We encourage clients to raise concerns directly with us first.
14.2 Mediation: If disputes cannot be resolved informally, we agree to attempt mediation before pursuing legal action.
14.3 Governing Law: These Terms are governed by the laws of the state in which services are provided.
15. COMPLIANCE WITH LAWS AND REGULATIONS
15.1 Licensing: We maintain all required state licenses and certifications for providing ABA therapy services.
15.2 Regulatory Compliance: We comply with all applicable federal, state, and local laws and regulations.
15.3 Insurance Regulations: We follow all requirements set by insurance companies and regulatory agencies.
16. TELEHEALTH SERVICES
If applicable, telehealth services are provided in accordance with state regulations and professional standards. You consent to the use of telehealth technology for consultations and training when appropriate.
17. CHANGES TO TERMS
We reserve the right to modify these Terms and Conditions at any time. Material changes will be communicated to active clients. Continued use of our services after changes constitutes acceptance of modified terms.
18. SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19. ENTIRE AGREEMENT
These Terms and Conditions, along with our Privacy Policy and any service agreements you sign, constitute the entire agreement between you and myHHBS.

CANCELLATION AND REFUND POLICY
1. Service Cancellation
Clients may cancel services at any time with written notice. We recommend providing at least 14 days notice to allow for proper transition planning.
2. Session Cancellations
- 24+ hours notice: No charge
- Less than 24 hours: May be charged for the session
- No-show: Will be charged for the full session
3. Payment Refunds
- Prepaid services: Unused prepaid amounts will be refunded within 30 days of termination
- Insurance claims: Refunds for overpayment will be processed within 60 days
- Service disputes: Refund requests will be reviewed on a case-by-case basis
4. Non-Refundable Items
- Completed assessment and evaluation services
- Materials and equipment provided to the client
- Administrative fees for insurance verification and records processing
5. Insurance Denials
If insurance denies payment for services already provided, you are responsible for payment of services rendered at our standard rates.
By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
